1. ABOUT US

2. BASIS OF SALE

These Terms and any quotation set out the whole agreement between you and us for the supply of our rubbish collection services, to the exclusion of all other terms and conditions.
Where we provide a quote without an initial site inspection, a contract is created upon your acceptance of that quote (via telephone, email, or otherwise). We reserve the right to vary the price if the information provided at the time of the quote was incomplete or inaccurate.
Where a site visit is required to provide a quote, no contract exists until the inspection is complete and a formal quotation is issued. Any prior price indication is an estimate only.
Quotations are valid for 30 calendar days from the date of issue unless withdrawn by us in writing.

3. CANCELLATIONS AND CHARGES

No Cancellation Fees: You may amend or cancel a booked collection at any time without incurring cancellation charges.

Access Issues: If items cannot be removed because they are too large for doorways/access points:

If we attempt to dismantle an item (e.g., removing table legs) and it still does not fit, we are not responsible for reassembling that item.
If a third party is required to assist with access, you are responsible for those third-party costs.

Time Allocation: We allocate specific time slots based on load size:

¼ Load: Up to 15 minutes.
½ Load: Up to 30 minutes.
Full Load: Up to 1 hour (based on a standard 16 cubic yard lorry).

We reserve the right to charge an additional fee if the clearance takes longer than the allocated time for the volume of waste.

4. PROVISION OF SERVICES

We will provide services with reasonable care and skill, unless prevented by a Force Majeure Event.
We make every effort to meet removal dates, but delays due to circumstances beyond our control may occur. We will contact you to arrange a revised date as soon as possible.
Access: You must provide free and safe access to the premises. You must notify us of difficulties (e.g., heavy items, long carries, parking restrictions). Failure to provide accurate information may result in a cancelled collection or additional charges.
Authority: You confirm you have full authority for us to collect and dispose of the rubbish. You shall indemnify us against any costs incurred from third parties if you do not have the proper authority.
Hazardous Materials: If we detect or suspect asbestos or other hazardous/dangerous materials, we may immediately vacate the premises. You remain liable for the service fee in full. If such materials are loaded before discovery, we reserve the right to charge for expert removal costs.
Safety: Sharp objects (knives, broken glass) must be stored in appropriate hard containers, not bags, for the safety of our staff.

5. PRICE AND PAYMENT

The price of services will be as set out in our quotation.
Payment is due at the time the service is performed, unless otherwise agreed in writing.
We reserve the right to suspend further services if outstanding amounts are not paid.
All payments must be made in full without deduction or set-off.

6. LIMITATION OF LIABILITY

We do not limit liability for death or personal injury caused by negligence, fraud, or breach of implied statutory obligations.
Subject to the above, we are not liable for loss of profit or indirect/consequential losses. Our total liability shall not exceed the price of the services provided under the specific contract in question.

7. EVENTS OUTSIDE OUR CONTROL (FORCE MAJEURE)

We are not liable for failure to perform due to events outside our reasonable control, including but not limited to: strikes, riots, terrorist attacks, fire, storms, floods, pandemics, or the impossibility of using public/private transport and telecommunications.

8. TERMINATION

We may terminate the arrangement at any time by providing 48 hours’ notice. Termination does not affect our right to recover money owed under these terms.

9. DATA PROTECTION

We use your personal information only to provide our services or to inform you about similar services we offer (unless you opt out). We do not pass your data to third parties, except where necessary for credit reference or legal requirements.

10. NOTICES

Notices to us must be sent to 17 Hampstead High St, London NW3 1PX or office@rubbishremovalhampstead.co.uk. Notices to you will be sent to the email or postal address provided at the time of booking.

11. GENERAL

Severability: If any part of these terms is found invalid by a court, the remaining terms remain in effect.
Waiver: Failure to enforce a right does not mean we waive that right in the future.
Governing Law: These terms are governed by English law, and both parties agree to the exclusive jurisdiction of the English courts.
Amendments: We reserve the right to revise these Terms. You are subject to the version in force at the time of your order.
